廣播電視事業的外資限制法規範究竟是文化守護神？還是國際化與自由化的絆腳石？本文旨在探討支持與反對外資限制的理論與背景，同時藉由比較法研究的取向，剖析各國廣播電視事業外資限制的法規以及各國因應服務貿易總協定（GATS）服務業開放架構的反應。掌握國際經濟法律變遷的趨勢，以及本地經濟文化論述與情境描述，加以綜合判斷，以作為我國採取因應政策的依據。根據研究發現，本文建議以更細緻的觀點規畫外資限制的法規範，導出「內容先於結構」開放之原則，並就就不同產業別加以檢討，在漸進式自由化的原則下，適度引進外資。而最後針對法律執行成效加以評估，就實然面提出具體的對應策略。

This paper explores the theories and contexts of the foreign investment regulations of broadcasting industries. Since the cultural industries are not exempted from the General Agreement Trade of Services (GATS), our broadcasting law is to face the challenge of internationalization, globalization and liberalization. The researchers also point out that while we deregulate those investment rules, the local broadcasting industries should be free to develop and implement their own cultural policy. By focusing on analyzing twenty-seven countries ’ regulations on foreign investment regulations of broadcasting industries, this study attempts to come up with some working suggestions for revising the current broadcasting regulations in Taiwan.
