創用CC用於解決廣播電台歌曲使用授權爭議之探討

本文試圖探索在創用CC授權的機制下，如何讓歌曲著作可以運用CC的授權，讓非商業的使用者可以自由運用，也能另外授權著作權仲介團體，方便欲用於商業目的使用者取得在商業性用途利用的授權，替廣播電台使用歌曲所發生之爭議找到解決方式，同時也不影響相關著作權仲介團體以及著作權人或創作者的獲利，在保護商業利益以及「調和社會公共利益，促進國家文化發展」之自由與開放精神之下，找到調和的平衡點。
根據研究結論，本文認為利用創用CC授權條款，可以降低歌曲的授權交易與宣傳成本，而當欲用於商業用途的使用者或團體想要運用該創作者帶有「非商業性」條款的作品時，也必須與著作權仲介團體洽談商業用途授權使用金，在此種互蒙其利的情況下，因應採用創用CC授權條款著作人的需求，國內著作權仲介團體應可考慮提供不同著作財產權授權契約版本，似無將使用創用CC授權條款的著作拒於門外的理由。

Creative Commons licenses are not an alternative to copyright. They work alongside copyright. Therefore, under the condition of not to affect the interests among songs writers, music copyright societies and music copyright owners the analysis tries to focus on how CC licenses could be used as a solution to the dispute between radio stations and music copyright societies about the use of songs.
