有線電視系統業水平整合之競爭政策研究

本研究認為，因應科技的進步，有線電視經營區的限制已無必要，未來應允許\業者跨區經營。NCC 制定政策時，無須擔心違憲爭議。除此之外，NCC 積極地促進其他 MVPD 的競爭，例如 MOD 或數位無線電視，這樣才能保障消費者的權益。目前《有線廣播電視法》水平整合市場力量的計算，以「有線電視總訂戶數」為準。然而，本研究建議，現在已經有諸多視訊平台讓民眾接觸影視節目，應該將「具有競爭關係」的 MVPD 都納入，才能真正測量市場力量，也才能達到管制的目的。

The conclusions of the research revealed as follow: first, considering the technology progress, the restrictions on cable television operation area are not necessary. Instead, this study suggest each operator can run its business in other area. Don’t worry about the constitutional dispute. Second, in order to protect the profit of consumers, NCC should promote the competition between cable television and other MVPD, such MOD and Digital terrestrial television. Last, According to "Cable Television Act, " the calculation of horizontal integration is based on “the total cable television subscribers.”However, I think it should base on “the MVPD subscribers.” Then, it will reach
the goal of regulation.
