《電信管理法》自 2019 年立法通過後，逐步取代既有的《電信法》，成為電信產業的新法規框架。但是，同屬通訊傳播匯流法制框架一環的傳播法制，其修正方向和策略迄今未見明朗。本研究以臺灣視聽媒體平臺為研究核心，採法政策學取向，針對我國現行通訊傳播匯流法制中的營運管理層，解析電信和傳播二者之間的管制爭議，並對管制框架之設計原則和管制模式，提出適當且可行之建議。

 The legislation of the Telecommunications Management Act in 2019 has become the new legal framework for telcos and gradually replaced the existing Telecommunications Act. However, Taiwan's communications convergence regulatory framework still needs to be clarified in recent years. The study takes the approach of legal policymaking to deconstruct the regulatory issues of operation and management layer in Taiwan. It suggests construct an appropriate and feasible regulatory framework for audiovisual media platforms. In addition, while relaxing the regulations of the existing broadcasting services, it is necessary to establish a well-functioned industrial self-regulation organization for audiovisual media platforms. Law and regulation enforcement is the last measure to take after the industrial self-regulation and the co-regulation with the participation of the stakeholders, including the industry, the civic groups, and the government.
